Guidelines for the improvement of private open spaces

 

We are often asked by Port Owen residents whether they could 'take over' one or other of the Private Open Spaces around Port Owen. Whilst we encourage the beautification of our lovely suburb, there are certain guidelines which we must bring to the attention of anyone proposing to improve these private open spaces.

  1. Private Open Spaces are the property of the Bergrivier Municipality which have been leased to POMA on a 99 year lease agreement. No changes of any kind may be made to the property without the express written permission of POMA.
  2. Residents of Port Owen may, with POMA's permission, improve the private open spaces by way of establishing gardens. No permanent structures of any kind may be erected on the private open space, nor may any paving be laid without the express written permission of POMA.
  3. No vehicles or boats-and-trailers may be parked on private open spaces without the written permission of POMA. In the event that POMA does give such permission, then such permission will only serve as a temporary measure for a specified term.
  4. No private open space may be fenced off in such a way as to prevent the pedestrian access of other residents to the area or to restrict the access of emergency vehicles and municipal services.
  5. No improvements may be made to the private open space in such a way as to convey the impression that the private open space is the property of the person making the improvements.
  6. POMA reserves the right at all times to cut, trim or remove any vegetation and to dismantle and remove any structures, paving etc. from the private open spaces without giving the reasons therefore.
  7. POMA may take whatever steps are necessary to demarcate the extent of the private open space and to prevent vehicle access.
  8. In the case of any dispute, the decision of the board of directors of POMA will be final.
You are welcome to approach the board with your proposals for the improvement of any private open space under POMA's control.
